A legally binding attorney-client relationship is, however, only formed after a written retainer agreement is executed, initial fees - if any - are paid, and a conflicts check is performed. Merely sending an e-mail or fax or placing a telephone call does not create such a relationship. Never transmit confidential information to any attorney prior to formally retaining that attorney.
NB: Electronic mail and wireless communication devices including cellular telephones are inherently insecure methods of communications; no electronic transmission of information can be completely protected against disclosure to third parties. When communicating trade secrets or other sensitive or confidential information to a lawyer, Attorney recommends employing a land line telephone/facsimile or face-to-face meeting; when failing to do so, you are taking the risk that the communication may be intercepted, intentionally or otherwise.
